Sir:-
am directed by Secretary Sir Edward Grey to
to acknowledge the receipt of your letter (38277/1907)
relative to the fees paid at certain Chinese ports to
the British Consuls in respect of their services as
Emigration Officers.
In reply, I am to observe that as the Government
of the Straits Settlements does not possess the power,
(conferred by the Chinese Passenger Act of 1855 upon
the Government of Hongkong) to issue instructions for
the levy of fees for Certificates required by the
Straits Settlements Ordinance No. 19 of 1902, it is
presumed that His Majesty's Secretaries of State are
equally unable to authorise the levy of such fees.
In these circumstances it would seem that an Or-
der in Council under the Consular Salaries and Fees
Act, 1891, is necessary in order to regularise the posi-
tion
